Koh Mak News provides local information and may offer additional services and features, including business-information tools, notification services, user accounts and sign-in functions, Koh Mak Game and other interactive services.
2. Acceptance of these terms
By using Koh Mak News or any of its services or interactive features, you agree to these Terms of Service. If you use the service on behalf of a business, you confirm that you have authority to act for that business.
Certain features may also have additional instructions or rules shown within the relevant service. Where applicable, you agree to follow those instructions or rules when using that feature.
3. Accuracy of information
Information published on Koh Mak News may be provided or updated by business owners, operators, users, public sources, Google or other third-party services.
Koh Mak News makes reasonable efforts to provide useful and current information, but we do not independently verify every item and do not guarantee that information is accurate, complete or current. In particular, opening hours, temporary closures, prices, schedules, availability and other operational information may change at short notice.
Users should confirm important information directly with the relevant business or service provider before relying on it. To the extent permitted by applicable law, Koh Mak News is not responsible for loss, damage or inconvenience resulting from inaccurate, incomplete or outdated information published through the service.
4. Responsibility of business owners and contributors
If you submit, update or manage business information through Koh Mak News, you are responsible for ensuring that the information is accurate and that you have the right to provide, publish or modify it.
You must not represent yourself as the owner or authorised representative of a business if you are not authorised to act for that business.
5. Accounts and sign-in
Some Koh Mak News services require or allow users to identify themselves or sign in using an email address, a one-time login link, LINE, Google, Facebook or another supported sign-in method.
You are responsible for using your own account or an account that you are authorised to use and for taking reasonable steps to protect access to your email, device and third-party accounts.
Koh Mak News does not ask for your LINE, Google or Facebook password. Authentication through those services is handled through the relevant provider.
6. Notifications and alerts
Koh Mak News may allow users to subscribe to selected notifications, including local news, transport or service alerts. Users can change or stop their Koh Mak News notification subscriptions using the controls provided by the relevant service where available.
Notifications are provided as a convenience. They may be delayed, incomplete, unavailable or affected by information received from third parties, internet connectivity, messaging platforms or other circumstances outside our control.
Important travel, transport, weather, safety or service information should be confirmed with the relevant operator, authority or official source before relying on a notification from Koh Mak News.
7. Koh Mak Game
Koh Mak Game is an interactive feature in which users may join a game, visit designated locations, submit photos or other required information, and receive points or appear in a leaderboard according to the game rules and the validation of submitted tasks.
Some tasks may require the player to be physically present at a designated location. The service may use GPS information contained in a submitted photo or location information that the player explicitly chooses to share from the device in order to verify that the player is at or near the required spot. Further information about location data is provided in the Koh Mak News Privacy Policy.
Submissions may be reviewed and approved or rejected. Invalid, duplicate, misleading or otherwise non-compliant submissions may be rejected or removed. Scores and game progress may be adjusted where reasonably necessary to reflect valid game participation.
Display names, scores and game progress may be shown publicly in a leaderboard or other game display. Full names and email addresses are not intended to be displayed publicly as part of the leaderboard.
8. User-submitted content
If you submit photos, text, business information or other content to Koh Mak News, you confirm that you have the right to submit that content and that it does not unlawfully infringe the rights of another person.
You retain ownership of content that you submit. By submitting content, you give Koh Mak News permission to store, process, display where the relevant feature requires it, and review that content to the extent reasonably necessary to provide, administer and protect the service in which it was submitted.
Koh Mak News may remove submitted content where reasonably necessary because it is unlawful, misleading, abusive, technically harmful, unrelated to the service, or inconsistent with the applicable feature or game rules.
9. Google Business Profile connection
Koh Mak News may allow business owners or authorised representatives to connect a Google account through Google’s authorisation process.
If you connect a Google Business Profile, you confirm that you own the business or are otherwise authorised to manage that profile. Koh Mak News may use the authorisation to read relevant Business Profile information and, when requested through the service, send updates such as opening hours, special hours or opening status to Google.
You remain responsible for changes that you instruct Koh Mak News to send to Google. Connecting a Google account does not provide Koh Mak News with your Google password.
10. Third-party services
Some Koh Mak News functions depend on third-party services, including LINE, Google and Meta/Facebook. Their availability and operation are outside our control and may be subject to their own terms, privacy policies and technical limitations.
Koh Mak News is not responsible for changes, outages, suspensions, account restrictions or decisions made by third-party service providers.
11. Availability of the service
Koh Mak News does not guarantee uninterrupted availability of the website or any particular feature. Services may occasionally be unavailable because of maintenance, technical problems, internet connectivity, third-party services or circumstances outside our control.
Features may be changed, added, suspended or discontinued as the service develops.
11A. Embedded boat timetable widget
Website owners may embed the Koh Mak News boat timetable widget free of charge using the embedding code we provide. The widget’s visible attribution and link to Koh Mak News must remain intact.
The widget displays timetable information and service alerts supplied by Koh Mak News. Schedules, prices, availability and alerts may change at short notice. Visitors should confirm important travel information directly with the boat operator before booking or travelling.
Timetable information and alerts update automatically. The widget’s appearance and functions may also change as the service develops. We do not currently provide a fixed-version option or automatic email notifications to embedding website owners about changes.
Embedding the widget does not imply endorsement of the embedding website by Koh Mak News. Website owners may stop using the widget at any time by removing its embedding code.
When the widget loads, visitors’ browsers connect to Koh Mak News and its infrastructure providers. Website owners are responsible for explaining the embedded service in their own privacy information and obtaining any consent required for their implementation. Further details are provided in the Koh Mak News Privacy Policy.
12. Acceptable use
You must not misuse Koh Mak News, attempt unauthorised access, interfere with the service, deliberately submit false or unlawful information, impersonate another person or business, misuse another person’s account, manipulate game submissions or scores, or use the service to access or modify a Google Business Profile that you are not authorised to manage.
You must not use Koh Mak News in a way that is unlawful, abusive, fraudulent, harmful to other users or businesses, or likely to damage or disrupt the service.
13. Correction, suspension and removal
Koh Mak News may correct, hide or remove information that is demonstrably inaccurate, unlawful, misleading or no longer relevant.
We may restrict or suspend access to particular features or services where reasonably necessary to protect the service, users, businesses or third parties, to address misuse or security concerns, or to maintain the integrity of Koh Mak Game and other interactive services.
14. Privacy and personal information
Our handling of personal information, account information, notification preferences, location information and Google user data is described in the Koh Mak News Privacy Policy.
Users should read the Privacy Policy before using features that involve sign-in, location sharing, photo submissions, notification subscriptions or Google Business Profile access.
15. User data deletion
You may request deletion of personal information held by Koh Mak News, including information associated with sign-in, notification subscriptions or interactive services, by contacting us at [email protected].
Where a third-party sign-in provider is used, you may also revoke Koh Mak News access through the controls provided by LINE, Google or Meta/Facebook. Revoking access with a third-party provider does not automatically delete information already stored by Koh Mak News.
After receiving a valid deletion request, Koh Mak News will delete or anonymise the relevant information where reasonably possible, subject to information that must or may be retained for legal obligations, security, fraud prevention, dispute resolution or legitimate administrative purposes.
To request deletion, email [email protected] with the subject “Data deletion request” and include enough information for us to identify the relevant account or service record. We may ask for reasonable verification before deleting information in order to avoid deleting another person’s data.
16. Children and minors
Koh Mak News services are intended for general users. Where applicable law requires consent for a minor to use a particular feature or for personal information to be processed, the necessary consent must be provided by or together with a parent or legal guardian as required by law.
Parents or guardians may contact Koh Mak News regarding information associated with a minor.
17. Limitation of liability
To the extent permitted by applicable law, Koh Mak News is provided on an “as available” basis. We are not liable for indirect or consequential losses resulting from reliance on published information, delayed or missing notifications, temporary unavailability, third-party services, game participation, or changes or submissions made by users through the service.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.
18. Changes to these terms
We may update these Terms as Koh Mak News develops or legal and technical requirements change. The current version will be published on kohmaknews.com and the effective date will be updated.
